Countdown to Expanded DACA

UPDATE February 17, 2015: Due to a Federal Judge's temporary injuction, U.S. Citizenship and Immigration Services will not begin accepting applications for Expanded DACA as previously planned.  Updates available at


U.S. Citizenship and Immigration Services has announced that it will publish the rules and application for Expanded DACA in less than two weeks, on Feburary 18, 2015. Interested applicants can contact ICS or another trusted AILA lawyenow to ask about eligibility get ready to apply.

What is Expanded DACA?

On November 20, 2014 the Obama administration expanded the rules for Deferred Action for Childhood Arrivals (DACA), originally announced in 2012.  To date, over 8,500 Oregonians have received a work permit through DACA.  The new rules will expand the number of eligible individuals in the state.

What remains of original DACA?

Expanded DACA left most of the requirements for DACA the same as the 2012 version.  To qualify, you still must:

-Have arrived to the U.S. before age 16
-Be in school now, have your GED or Diploma, or be an honorably discharged veteran of the U.S. armed forces
-Be at least 15 years old when you apply
-Have been presence in the U.S. on June 15, 2012
-Not have a criminal record that bars you from eligiblity (always talk to a lawyer about any arrests or juvenile matters before applying).

What changed?

Expanded DACA changed some requirements, allowing more individuals to qualify.  The changes include:

-Removal of the age cap.  As long as an individual meets the other requirements, there is no longer a maximum age to apply.
-Applicants must have been continuously present in the U.S. since Janary 1, 2010.  
-Work authorization for three years.  Previously DACA recipients were granted two.
